another "erratic decision" on live exports, putting at risk Australia's relations with
its trading partners.

"You don't deal with your neighbours by tying a note to a brick and throwing it through

"If we go down this path again we are not going to make good neighbours, we are going
to make bad ones, and that is not the sort of neighbour Australia wants to be.

"This is far deeper than the emotive chess-playing the Greens are playing at, because
we know what the ultimate agenda is - ultimately they would like to shut down the cattle
trade full stop."

CAIRO - "Last night it was beautiful, it was a miracle," said Haneen, a drama and translation student at Cairo University, of the demonstrations that rocked the city on Friday's "Day of Rage."

A government-imposed curfew of 6 p.m. was widely ignored as tens of thousands of Cairenes took to the streets to shout for a change in their government.
Friday was a tipping point in the capital, and on Saturday the optimism was hard to contain. Across the city there is a glowing satisfaction in knowing that they have made their point loud and clear - the army was listening, the world was listening and most of all, Hosni Mubarak was forced to start listening to the people. Now, the demonstrators feel, if they can keep the momentum going, it will carry them forward to change in the next few days.

A communications blackout was partially lifted on Saturday morning, when cellphones started working at 11 a.m. Internet was still down on Saturday night.

"We don't know what the world is saying, or even what's going on in the country; it's like we're blind," said Tarek Muhammad, a second-year communications student at Cairo University, located in the Giza suburb, 15 kilometers from the pyramids.

There is a great fear in Egypt that because of the communications blackout, the world will not see what is happening in their country and therefore will fail to put pressure on Mubarak.

On Friday, police targeted the international media. BBC photographers had their cameras smashed, a journalist from the Guardian was severely beaten and other journalists shared stories on CNN of police violence directed at destroying their communications.

Every time I brought out my camera during the demonstrations and said I was from America, dozens of people would crowd around me and try to get their message out. They were clear - they like Americans, but they blame the American government for their situation today, for supporting the Egyptian government with over a billion dollars a year in military aid.

Protesters filmed by Al-Jazeera held up some of the shells from live ammunition that has been fired at the crowd and chanted, "America! America!"

"We want America not to be involved, and not to conflict in our business," said Ahmed al-Masri, a Giza resident. "We can manage our business ourselves, we can do it! America is just looking out for its own interests. We have a lot of young Egyptians, and people in general, who want Egypt to be better; we don't want interference from Israel or America or any other foreign country. We will continue our struggle for a good Egyptian future."

The message from the streets is getting out - to America, to Europe and especially in the Arab world. The popular protests rocking the region may not have started in Egypt, but here they have been the largest and the most violent. As Egypt is the most populous Arab country, with more than 80 million citizens, these demonstrations are something of a barometer for public sentiment in the other Arab countries.

"We Muslims are all brothers," Masri said. "We are happy about what happened in Tunis and we want it to happen in every Arab country; we want freedom."

But he warned that Egypt needs to concentrate on its own goals before worrying about the example it is setting.

The military's presence in the streets signals an important change, that the police have given up and have ceded their role to restore order.

"[Last night], we were chanting, 'Where is the army, we want the army,' and then the army came!" said Haneen, the drama student, as she pointed out a tank that was covered with cheering people of all ages.

The protests are a wave of humanity - young, old, religious, secular. Some come in wheelchairs, others carry toddlers on their shoulders. The tear gas is strong and many people have blood- spattered shirts and freshly bandaged wounds. A few times a day large swathes of Tahrir Square are cleared so that men can kneel down and pray, hundreds at a time.

The anger is real, as is the optimism, that finally, the people have been loud enough to make their opinions heard.

"We have been angry for 30 years!" one man shouts at me as we are swept across a bridge over the Nile toward the huge square.

But there is hope that finally something will change.

SYDNEY, Dec 19 AAP - A convicted pedophile has surrendered to NSW authorities six days
after ditching his electronic monitoring anklet and fleeing home detention.

Troy Myers was on parole and living in a community offender residence in Sydney's south-west
after serving four years in jail for the aggravated sexual assault of a person under 16.

He bolted from the Campbelltown residence on Sunday, allegedly removing his monitoring
device after Department of Corrective Services staff told police he had recorded a blood
alcohol reading of 0.119, contravening his parole.

Corrective Services personnel delivered the 28-year-old man to Campbelltown police
at 3.30pm (AEDT) on Friday after his family convinced him to surrender.

Corrective Services Commissioner Ron Woodham said the department's Community Compliance
Group (CCG) had worked around the clock on the case.

"With the support of my officers in the community compliance team, this offender's
family convinced him to give himself up," Mr Woodham said in a statement.

It was the third time Myers has breached his parole since being released from prison
in September, Mr Woodham alleged.

"On the first two occasions, Myers was taken back to court, but magistrates decided
to again release him," he said.

"This was after CCG officers had conducted urine analysis tests on him and found the
drug ice in his system."

The NSW Opposition accused Corrective Services of jeopardising public safety by not
revealing Myers was missing until Thursday when NSW police appealed for public assistance
in finding him.

"It's very odd and unacceptable that it's taken five days for the Corrective Services
Department to make this public," legal affairs spokesman Greg Smith told reporters in
Sydney on Friday.

"A pedophile out on the loose, who's been said by police to be dangerous, should always
be the subject of an urgent warning to parents and to other people that he's to be detained
or to be avoided and police are to be alerted.

Mr Smith said there was a culture of cover-up and secrecy within the Corrective Services
Department, but Mr Woodham said his department passed the matter on to police within two
hours of Myers' breach.

"There is no cover-up in this matter or in any other matter and I reject his ridiculous
claims," Mr Woodham said.

Police said officers responded immediately once the Myers matter was reported to them.

"Once the arrest warrant had been obtained by Corrective Services, and after a number
of legitimate investigative avenues proved fruitless, police made a public appeal to find
him," a spokeswoman for NSW police said in a statement.

Mr Smith said tougher release conditions for sex offenders were needed, along with
more parole officers.

BEIJING, Aug 14 AFP - Roger Federer complained the Olympic tennis schedule was "ridiculous"

after playing six matches in four days.

The top seed won his singles match against Tomas Berdych and had just one hour and
40 minutes to recover before returning for the doubles.

"I find it a little bit ridiculous that we're playing maybe 11 matches in seven days,
to be honest," Federer said.

"I know it rained the first day. But quite honestly, I don't understand why we don't
play such a big tournament over 10 days maybe.

"That's the only regret I have at the moment because I think this is asking just a
little bit too much and too much trouble."

The event is Grand Slam-size but played in almost half the time -- eight days rather
than a fortnight -- and most of the first day was lost to rain.

Rafael Nadal started playing at 10.30am on Monday and didn't finish until late that evening.

The same day, Sam Querrey played Igor Andreev - and then stayed on court to face him
in the doubles.

Federer complained the format was "very hard" on the players, most of whom will compete
in the US Open which starts a week on Monday.

"They've made it very hard on us players and I wish there were extra days for us to
play," Federer said.

"But that's the way it is right now."

The Swiss has played two previous Olympics, finishing fourth in 2000 and losing in
round two four years ago.

"I know the difficulty of trying to win a medal here," he said.

"It's a difficult forum, winning six matches in seven days plus five doubles matches
if you want to win gold there as well."

Tasmania Police are searching for a 21-year-old man who absconded from Hayes Prison
Farm this morning.

Police say the man escaped around 10.10am (AEDT) .. and is believed to be in the New
Norfolk and Greater Hobart area.





He is 181 cm tall .. shaved hair with red-brown stubble .. medium build .. fair complexion
.. with a tattoo of two tear drops below his left eye.

He was last wearing khaki prison pants, white runners .. Grey windcheater and a bright
orange polar fleece top.





Although not considered to be dangerous .. members of the public are advised not to
directly approach the man and to contact police on 131444 or Crime stoppers on 1800 333

SYDNEY, Dec 3 AAP - A garbage truck has veered across a major road and smashed into
a house in Sydney's south-west, causing significant structural damage, police say.

The garbage truck was headed south on the Camden Bypass about 10.30am (AEDT) today
when the incident occurred.

Police said the male driver veered across four lanes of traffic onto the incorrect
side of the road.

The truck then mounted the kerb and crashed into the rear of the house on Shoemark
Place, causing significant structural damage.

Two people home at the time were not injured.

The truck driver was treated at the scene for minor injuries.

Police said it was not yet clear what may have caused the incident.

+ A man who reached down a rabbit burrow and pulled out 68 sachets of speed in front
of a watching police officer in Tasmania has been cleared of drug trafficking. Justice
Alan Blow said he "had some hesitation" in believing Robin Wayne Simpson's claim that
he was trying to catch a rabbit for dinner. He didn't believe Simpson knew the drugs were
there otherwise he wouldn't have retrieved the parcel in front of police. Simpson was
convicted and fined $50 for possession.



+ Perving, eyeing off and checking out are all generally thought to be the main hobby
of men, but research has revealed women are the main offenders when it comes to ogling.

Scientists used eye-tracking technology to pinpoint what people looked at when shown a
series of sexy photos. They expected women to be more interested in faces and men in genitals.

But to their surprise they found men are more likely than women to linger on the face
before diverting their attention to other parts of the body. Women also spent longer poring
over images of couples performing sexual acts.



+ A 13 year old girl is lucky to have escaped with minor injuries after being attacked
by a sea lion near Perth. Ella Murphy was being towed behind a speedboat on a surfboard
when the sea lion, which rarely attack, savaged her twice. She was rushed to hospital
with a jaw injuries. The sea lion's bite missed one of the victim's arteries by just one
millimetre, and several of her teeth were knocked out.

NSW: Court rejects appeal of "lenient" sentence for cop attack

A New South Wales court has upheld a minimum two-and-a-half year sentence .. for a
woman who blinded an off-duty policewoman in one eye during a nightclub attack.

The crown had appealed TYNEAL JENKINS' maximum five-year jail term .. for the October
2004 attack on the policewoman at a north-west Sydney nightclub .. claiming it was manifestly
inadequate.

The offence carries a maximum 25 years' jail.

Despite labelling the jail term as very lenient .. the Court of Criminal Appeal has
upheld the sentence .. saying it won't intervene.

The 21-year-old assaulted 28-year-old BROOK CLINGAN at the Castle Hill Tavern in October 2004.







JENKINS had become enraged at Ms CLINGAN when she laughed at the way her boyfriend was dancing.

She tipped a schooner of water in Ms CLINGAN's face and then smashed the empty glass
into her eye.

In April she was found guilty of maliciously inflicting grievous bodily harm with intent.

Since the assault .. Ms CLINGAN has undergone seven operations for a detached retina
.. but is still blind in her right eye.

In his judgment today .. Justice CLIFTON HOEBEN said it's unlikely she'll be able to
return to active police service.

But Justice HOEBEN says he won't change the sentence .. as he's satisfied it's still
within the range of sentences open for the charge.

Justice HOEBEN's decision was supported by Justices CAROLYN SIMPSON and GRAHAM BARR.

Australia and Indonesia are beefing up their presence .. in waters between the two countries.

The federal government says warning shots were fired at suspected poachers off the
Northern Territory coast .. in an operation which netted almost 200 fishermen on 23 boats.

Justice and Customs Minister CHRIS ELLISON says illegal fisherman are getting more
aggressive in their tactics .. although he warning shots were not fired directly at any
crew members.

And Defence Minister BRENDAN NELSON has foreshadowed a significant new push to police
Australia's northern waters.

Dr NELSON says while cooperation from Indonesia is helpful in the fight against illegal
fishing .. Australia needs to be self-reliant.

The announcement also follows a report of more Papuan asylum seekers arriving in the
Torres Strait .. this time a boatload of six people.

Meanwhile .. Indonesia has increased naval patrols between Australia and Papua .. amid
the row over Canberra's decision to grant temporary visas to 42 Papuan asylum seekers.



MENTAL (CANBERRA)

The Prime Minister's one-point-eight billion dollar boost to mental health services
.. has received mixed reaction.

JOHN HOWARD says the additional money will be available over five years .. but already
the AMA says it's not enough .. and won't resolve Australia's mental health crisis.

Labor's health spokesman JULIA GILLARD says the package is disappointing and inadequate
.. while Opposition treasury spokesman WAYNE SWAN says it's better late than never.

New South Wales has welcomed the package .. although it says it must see the detail first.

And leading psychiatrist IAN HICKIE from the University of Sydney backs the announcement
.. but says the states must now match the commitment.



GANG (SYDNEY)

A gang rape victim .. who was 14 when she was assaulted at knifepoint .. says she's
still disappointed at the sentences handed down to her attackers.

The New South Wales Supreme Court has increased the jail terms for the 27-year-old
.. identified only as MSK .. and his 26-year-old brother MAK.

MSK will now serve 28 years with a non-parole period of 22 years .. while MAK has now
been jailed for at least 14 years .. with a maximum of 19 years.

The two men and their younger brothers .. 19-year-old MMK and 21-year-old MRK .. were
serving between 10 and 22 years for the rapes.



SHOTS MORGAN (SYDNEY)

Homicide detectives investigating a Sydney double murder .. say they've identified
a third person of interest.

Police say the person was NOT at the scene of the shooting murders of 26-year-old boxer

asbestos was found there.

The immigration department's confirmed asbestos was discovered when a housing developer

A Sydney man charged over the Cronulla race riot has been released on bail after lodging
an appeal against his jail sentence.

19-year-old DANNY GLEN SHANAHAN was today sentenced to at least 10 weeks in prison
for attacking Safi Merhi during racially motivated violence at Cronulla on December 11
last year.

Immediately the sentence was handed down in Sutherland Local Court, SHANAHAN'S lawyer
.. LIONEL RATTENBURY .. lodged an appeal that led to his client being released on bail.

Meanwhile .. Sydney detectives investigating the Cronulla riot concede the case against
six men accused of involvement in revenge attacks is in danger of collapse.

NSW: Scammer needed money for son's heroin addiction, court told

SYDNEY, Aug 4 AAP - A woman who scammed more than $130,000 from 10 elderly men she
met through lonely heart ads has told a Sydney court she needed the money to feed her
gambling habit and support her son's heroin addiction.

Susan Reed, 50, from Lambton in suburban Newcastle, netted $135,020 between 1997 and
May last year, after placing advertisements in newspaper personals columns seeking relationships
with men aged over 65.

Once she had befriended them, Reed would ask the men - the oldest of whom was 88 -

to send her cash or cheques to pay for cruise holidays or business ventures.

Swansea pensioner Desmond Matthews, 74, sent Reed $95,000 for a quarter share in an
alleged brothel and lost his life savings, the court was told.

The grandmother and mother of three, who was on parole when she committed eight of
the fraud charges, pleaded guilty last month to ten counts of obtaining money by deception.

During sentencing submissions in Downing Centre Local Court today, she said she used
the money to pay for her son's heroin addiction, to support her gambling habit and fund
a custody battle for her grandchildren.

Her lawyer Chris Pike said Reed was struggling to come to terms with years of sexual
abuse, a mental illness and the loss of her first husband and youngest son, who died from
hereditary heart disease.

"The personal circumstances of my client have been particularly tragic with the death
of her husband and son, his heroin addiction and her gambling," he said during sentencing
submissions.

"She has a credible desire to protect her grandchildren, which is evidence she is not
an evil sociopath.

"It is possible she can turn her life around, indeed if she does not she will look
forward to spending the remaining portion of her life in jail.

But crown counsel Sally Dowling said Reed had 93 prior fraud related convictions, had
already spent seven years in prison and was likely to offend again.

"She has an astounding number of previous convictions that are virtually identical
... the offender has cynically targeted and exploited vulnerable, lonely old men," Ms
Dowling said.

Crying in the witness stand, Reed told the court she was sorry for her actions and
had sent more than $9,000 to one of her victims.

"I have betrayed people who gave me their trust and I deceived them for my own gain," she said.

"I can't tell you how sorry I am. I can't tell these people how sorry I am. They have
no idea how sorry I am."

Judge Stephen Walmsley will sentence Reed on September 2.

Why solid admin support is so important.(MEASURINGUP)

During the past few months, I have been zooming around the country teaching seminars and speaking at roofing conventions. On several occasions, I was speaking one-on-one with roofing contractors who commented about their strong administrative help. However, when I was trying to offer business advice, they could not provide the basic business data I was asking for. Having strong admin support is crucial to building a successful contracting business. Yet, I wonder if a lot of roofing contractors really understand what that support should look like.

Most contractors are disorganized, don't like paperwork and prefer sales and field work to office duties. Roofing contractors are no exception. If you are a disorganized person, such disorder is part of your personality and probably how you are wired. The tendency is for disorganized people to buy organizational self-help books, day planners and even electronic help like a smart phone. The books and planners tend to gather dust on the shelf and the smart phone--well, they use it as a phone and toy to play on the Internet. If you are disorganized or don't like admin work, admit it and find someone to help you with these tasks. As many contractors grow, they mistakenly hire construction managers, estimators and salespeople to help them prior to establishing sound admin support. Such a practice can end up creating overpaid clerks--plus you do not have the data necessary to monitor and manage their performance.

So what does good admin support look like? For starters, if you have to tell administrative people what to do, you probably have the wrong people in place. You are looking for someone who is assertive, organized and has strong computer skills--someone who will help keep you and other revenue producers on task. A good office manager is detailed oriented, friendly over the phone, loyal, supportive and driven to stay caught up. Ideally, he or she is someone the field is respectful of and maybe even be a little apprehensive about dealing with should they not get their paperwork in on time. These folks are not easy to come by.

So do family members make good admin support staffers? Maybe, but having family member in admin support may not be ideal. Family members telling each other what they should and should not be doing does not always go smoothly. If you do use family members, they must work set hours and have the same set of skills any other good office manager would have.

So what should such a person cost? Well, that will depend on the area of the country you are in and their skill set, but it is not uncommon for this person to cost the same as a lead field person or foreman. If you have a really strong office person, the cost of employing that person may not be the issue. The real issue is performance and finding the person that will get the job done.

So what are some of the tasks a good administrative person can perform? Well, here are just some of the things they can do for you:

* For residential contractors, they can set appointments, control sales calendars and qualify customers. This keeps salespeople from playing phone tag with customers and allows you to accurately track closing ratios.

* They help order material. If estimates include accurate material take-off lists, ordering material becomes an administrative task.

* Admin help can help maintain a schedule and call customers.

* Office help can perform data entry, manage day-to-day bookkeeping and keep financial data up to date.

* They can help with collections and deposits.

* Administrators can make sure customers have picked colors and product prior to job start-up.

* Repairs and service can be dispatched and billed.

* Sales literature and other marketing details can be kept up to date.

* They coordinate and provide valuable reports that track closing ratios, job profits and other necessary financial controls.

And, last but not least, they can be someone on your side. Administrators are someone you pay to help take the stress off of you and keep the business going. A good rule of thumb is that when sales go above $400,000 you need at least a part-time person and when they begin to go over $700,000 or $800,000 you probably need a full-time administrator. Herein lies the problem of using family members who may consider the job to be a part-time endeavor; they simply may not have the time to expand the position as sales increase.

We have discussed embezzlement in other articles, and I realize that trust is an issue for many contractors and may keep them from hiring adequate support. One way to avoid embezzlement issues is to do background checks and to have someone different balance the checkbook each month and review credit card statements.

Expanding your business without adequate administrative support ensures your basic operational issues will continue to happen and the company will continue to struggle. As salespeople, estimators and production managers are added and business expands, more paperwork and overall company tasks will be required. To make matters worse, lack of admin support will probably keep you from identifying and correcting job and sales issues.

If you want to make $100,000 a year income in your contracting business with a 40-50 hour work week, this equates to $40-$50 an hour. If you continually perform tasks worth $20 an hour, you are dead-ending your income and business growth.

Developments In The Laws On Publication In The Kingdom Of Saudi Arabia.

Since March 2001, freedom of expression in the Kingdom of Saudi Arabia (KSA) has been governed primarily by the Law on Publishing & Publications (Publishing Law). The scope of the Publishing Law was extended to electronic media in March 2011 by virtue of the Implementing Regulations of the Electronic Publishing (IREP). Royal Order No. O-71 (Religious Scholars' Law), and a subsequent royal order amending the Publishing Law (Amendment), further altered the scope and application of the Publishing Law. This article examines the content and practical effects of the Publishing Law, IREP, Religious Scholars' Law and Amendment (together the Laws).

Which activities are within the scope of the Laws? The majority of the provisions of the Publishing Law relate to "publications". The term "publication" is deemed to include any means of expression of a viewpoint that is made for circulation. This definition includes words, drawings, photographs and sounds, so encompasses newspapers, periodicals, radio transmissions and television broadcasts.

The Amendment does not extend the range of "publications" to which the Publishing Law applies, but focuses instead on increasing the scope of the persons protected by the Publishing Law, increasing the penalties, and prescribing an exclusive forum for enforcement of the Laws.

The provisions of the Publishing Law are not designed to deal with internet-based and other electronic media. This gap is filled by the IREP, which regulates a broad range of electronic publications, from electronic journals and news websites through to chat rooms, personal blogs and even text messages.

The recently published and enabled Religious Scholars' Law is arguably the most all-encompassing of the Laws, since its provisions apply to "all media channels".

On whom can liability fall under: (a) the Publishing Law? The author, publisher and printer of a publication that is considered to be an "internal/local" publication are all liable for any violation of the Publishing Law. If it is not possible to identify whether any of those individuals have committed the violation in question, liability shall fall on the distributor or seller of the publication.

The Publishing Law sets out separate provisions in relation to the "local press". The Editor-in-Chief of a newspaper is responsible for the newspaper's content. In addition to the Editor-in-Chief's overall responsibility for the newspaper, the writer of an article within the newspaper is responsible for the content of that particular article.

(b) the IREP? Under the IREP, the Editor-in-Chief of an electronic journal is deemed responsible for the content published in that journal. Likewise, the manager of an electronic news agency or electronic publishing house is deemed responsible for the content published by that agency or publishing house. In addition, the individual writer of text appearing on an electronic source shall be responsible for the content of that text.

What sorts of conduct may be considered violations of one or more of the Laws? The Publishing Law (as amended by the Amendment) prohibits publications from:

> The above list of prohibited activities also applies to all electronic publications within the scope of the IREP.

It would appear that any media channel which fails to avoid heresy, prejudice, exaggeration and extremism will violate the Religious Scholars' Law. Since the Religious Scholars' Law does not itself provide for penalties, however, it remains to be seen how the Religious Scholars' Law will be enforced in practice.

What are the penalties for violating any of the Laws? An increase in the penalties under the Publishing Law is one of the changes brought about by the Amendment.

For example, the Publishing Law gave the KSA's Ministry of Information the right, "in emergencies", to withdraw any publication which contained anything conflicting with Sharia'a principles. Following the Amendment, however, the Ministry of Information has the right, "whenever necessary", to withdraw any publication which is deemed to be carrying out any prohibited activity (of which conflicting with Sharia'a principles is only one example).

The Publishing Law provided that any violator of the Publishing Law would either be fined up to SAR 50,000 (currently equivalent to approximately US$13,300), or the enterprise responsible for the violation would be closed for a period of up to two months or permanently shut down. The Amendment has increased the fine to SAR 500,000 (currently equivalent to approximately US$133,000) and has provided for the fine to be doubled for repeat violations. In addition, the newspaper, electronic newspaper or website through which a violation occurs can, under the Amendment, be closed temporarily or permanently, and the violator may be prohibited from writing in any newspapers or other printed media, or participating in satellite channels.

By virtue of the IREP, the provisions of the Publishing Law setting out penalties for violations shall also apply in respect of electronic publications.

In addition to the penalties set out in the Laws, separate penalties may always be imposed arising from other law, particularly if content is deemed to violate religious law or to offend the sacred customs and traditions of the KSA. Such violations have resulted in the imposition of lashes and other penalties.

Whilst the financial penalties imposed by the Publishing Law have been increased in the Amendment, the Publishing Law and the Amendment provide for violations to be reviewed by a special committee established to handle media disputes. This committee will exercise exclusive jurisdiction to handle all claims involving the media and any complaints against the decisions of the committee will be considered by an appeal committee. In effect, this means that the regular and religious courts will no longer exercise any jurisdiction over broadcasts of content deemed offensive by any other authority or party in the KSA.

Winklevoss twins must accept Facebook deal.

Mark Zuckerberg won a legal battle against former Harvard classmates who accuse him of stealing their idea for Facebook, but the feud made famous on the silver screen is not over yet.

Cameron and Tyler Winklevoss must accept a cash and stock settlement with Facebook that had been valued at $65 million, a US appeals court ruled on Monday.

Meanwhile, a New York man filed an amended lawsuit against Zuckerberg on Monday, citing a 2003 email in which Zuckerberg discusses an urgent need to launch his site before "a couple of upperclassmen" could launch theirs, an apparent reference to the Winklevoss twins.

The Winklevoss brothers argued their settlement with Facebook was unfair because the company hid information from them during talks.

But the twins were sophisticated negotiators aided by a team of lawyers, 9th U.S. Circuit Court of Appeals Chief Judge Alex Kozinski wrote for a unanimous three-judge panel.

"At some point, litigation must come to an end," Kozinski wrote. "That point has now been reached."

Attorney for the brothers, Jerome Falk Jr., said on Monday his clients would seek a rehearing before a larger, "en banc" group of 9th Circuit judges.

That larger group can overrule a three-judge panel, although only a fraction of cases undergo such a review. Should the 9th Circuit refuse to rehear the case, the last option would be an appeal to the US Supreme Court.

Falk said he "respectfully" disagreed with the 9th Circuit s conclusions.

The 6-foot, 5-inch (1.96-meter) Winklevoss brothers are Olympic rowers who participated in the 2008 games in Beijing, and their saga with Zuckerberg was dramatized in the film "The Social Network."

In the movie, actor Armie Hammer played both identical twins. Zuckerberg s character snidely called them on-screen the "Winklevi."

Twins, along with Divya Narendra, started a company called ConnectU while at Harvard. They say Zuckerberg stole their idea. Facebook denies these claims.

Facebook took in $1.2 billion of revenue in 2010 s first nine months, according to documents that Goldman Sachs provided to clients to entice investors in a special fund set up to invest in the giant social networking firm.

The company was valued at $50 billion as part of that transaction. The company said on Monday it is evaluating the Internet market in China, but a source indicated it has not yet signed a business deal with any companies there.

The Winklevoss twins and Narendra agreed to a settlement that had been valued at $65 million. But they argue that, based on an internal valuation that Facebook did not reveal, they should have received more Facebook shares as part of the deal.

A lower court had granted Facebook s request to enforce the settlement with the Winklevoss twins and Narendra. The 9th Circuit agreed on Monday.
